Welcome to Ask Harold. By using the Ask Harold mobile application (the "App"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Ask Harold is an AI-powered technology assistant that provides:

• Answers to technology questions
• Help with troubleshooting technical issues
• Guidance on online privacy and security
• Analysis of images and documents related to technology

The App uses artificial intelligence (AI) models to generate responses. While we strive for accuracy, AI responses may sometimes be incomplete, inaccurate, or outdated.

4. Important Disclaimers

Not Professional Advice: Ask Harold is for informational and educational purposes only. The App does not provide professional advice in any field. Specifically:

• Harold is not a substitute for professional IT support or consulting
• Harold does not provide medical, legal, financial, or other professional advice
• Always consult qualified professionals for important decisions
• Do not rely solely on Harold for critical system configurations or security decisions

AI Limitations:

• AI responses may contain errors or inaccuracies
• Harold's knowledge may not include the most recent developments
• Complex technical issues may require human expert review
• Always verify important information from authoritative sources

5. User Accounts

To access all features of the App, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

6. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to extract harmful, illegal, or unethical content
• Harass, abuse, or harm others
• Distribute malware, spam, or malicious content
• Attempt to circumvent content safety measures
• Access or collect data from other users
• Reverse engineer, decompile, or disassemble the App
• Use the App for unauthorized commercial purposes
• Submit false or misleading information

Abuse of the service may result in account suspension, termination, or usage restrictions.

7. Content You Provide

You retain ownership of content you submit to the App (messages, images, documents). By submitting content, you grant us a limited license to process, store, and transmit your content as necessary to provide the service.

You represent and warrant that you have the right to submit any content you provide and that your content does not violate any third-party rights.

8. Subscriptions and Payments

Free Tier: The App provides limited free usage with a daily message quota.

Harold Pro: Premium subscription with unlimited messaging and additional features.

Payment Processing: All payments are processed through Apple (App Store) or Google (Play Store). We do not directly handle payment information.

Subscription Terms:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your device's account settings
• No refunds for partial subscription periods

Refunds: Refund requests are handled by Apple or Google according to their respective refund policies.

9. Intellectual Property

The App, including its design, features, and content (excluding your user content), is owned by Distributed Technologies LLC and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of the App.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately, and we may delete your data as described in our Privacy Policy.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• AI responses will be accurate, complete, or reliable
• The App will meet your specific requirements
• Any errors will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISTRIBUTED TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any AI-generated responses or advice
• Unauthorized access to or use of your data
• Any third-party conduct or content
• Any other matter relating to the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, DURING THE SIX MONTHS PRIOR TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Distributed Technologies LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

15. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if your claims qualify.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Distributed Technologies LLC regarding the App.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign these Terms. We may assign our rights and obligations without restriction.
